Supreme Court Curbs Arbitrary Re-Arrest; Magistrate’s Permission Required

ପୁନଃ ଗିରଫ ପାଇଁ ନୂଆ ପ୍ରକ୍ରିୟା। ମନଇଛା ଗିରଫ କରିପାରିବନି ପୋଲିସ, ନେବାକୁ ପଡିବ ମାଜିଷ୍ଟ୍ରେଟଙ୍କ ଅନୁମତି। ଯଦି ପୋଲିସ ସାମ୍ବିଧାନିକ ନିୟମ ଉଲ୍ଲଂଘନ କରିବା ଯୋଗୁଁ କୌଣସି ବ୍ୟକ୍ତି ମୁକୁଳି ଯାଆନ୍ତି, ତେବେ ପୋଲିସ ତାଙ୍କୁ ନିଜ ଇଚ୍ଛା ଅନୁସାରେ ପୁଣି ଗିରଫ କରିପାରିବ ନାହିଁ। ପୋଲିସକୁ ଏଥିପାଇଁ ନିର୍ଦ୍ଦିଷ୍ଟ ଗାଇଡଲାଇନ୍ ମାନିବାକୁ ପଡିବ।

The Supreme Court has laid down safeguards on the re-arrest of a person whose earlier arrest was declared illegal for violating constitutional protections under Article 22. In such cases, police cannot mechanically re-arrest the person; a subsequent arrest must be preceded by judicial scrutiny and approval from the jurisdictional Magistrate or court, after considering the necessity for arrest and detention. The ruling also emphasises safeguards relating to communication of the grounds of arrest and production before a Magistrate. The directions are aimed at ensuring that constitutional protections are not bypassed through a fresh arrest.
